Making a booking

All bookings are subject to these ‘Terms and Conditions’ except where prior arrangements have been made in writing by the Owners.

Provisional and telephone bookings will be held for 48 hours to allow for the booking form to be emailed; a provisional booking, after receipt of a booking form, will be held for seven days to allow for receipt of the deposit.

To reserve a property, complete and submit the booking form, together with a non-refundable deposit of 25% of the rent due. You will then receive a booking confirmation.

Failure to pay the deposit in full will constitute a cancellation of the rental period by the client. Reminders will not be issued.

The balance of the rental, together with the security deposit is payable not less than eight weeks before the start of the rental period. If payment is not received by the due date, the Owner reserves the right to give notice in writing that the reservation is cancelled. The Client will remain liable to pay the balance unless the Owner is able to re-let the Property. In this event, the 'Cancellation Charges' of these booking conditions will apply. Reservations made within 8 weeks of the start date of the rental period, require full payment at the time of booking.

The Client’s party must not exceed the number of people detailed on the booking form and agreed at the time of booking. The Owners have the right to cancel the rental if the number of people within the Client’s party exceeds those notified and agreed on the booking form. Should additional guests 'appear' a charge of 40euros per night or 150euros per week will be due.

Under no circumstances shall the Owners’ liability to the Client exceed the amount paid to the Owners for the rental period.

The Client is strongly recommended to arrange personal comprehensive travel insurance (including cancellation cover) and full cover for the party's belongings, public liability etc since these are not covered by the Owners insurance.

Security Deposit

A 250.00 euro/175 pound sterling security deposit is payable with the final rental balance - this will be held against any breakages, damages, loss of keys or equipment and additional cleaning. The Owner will account to the Client for the security deposit and refund the balance within one month of the end of the rental period; subject to any necessary deductions for damages, losses, additional cleaning or extras not separately paid for. If there are any charges in excess of the security deposit, the Client agrees to reimburse the Owners.

Any substantial damage caused by the Client, dependant children or the Client’s daytime visitors or behaviour of an unacceptable type will result in the immediate eviction of the Client’s party without compensation and will be subject to a claim for loss and damages by the Owners. In this event, the Owners will have no further contractual obligations to the Client.

Rental periods

The rental period will start at 1600 on the first day of the rental period until 1000 on the last day of the rental period unless previously agreed in writing with the Owners. The Owner shall not be obliged to offer the accommodation and facilities before the time stated, and the Client shall not be entitled to remain in occupation after the time stated.

The Owners cannot be held responsible for changes to the Clients travel arrangements.

Services, linen and cleaning

Charges are inclusive of water, gas and electricity charges (where appropriate) in high season. Gas, water and electricity will be metered on consumption and unreasonably high usage will be charged to the security deposit. Unreasonable usage will be determined by, and at the sole discretion of, the Owners.

Charges are inclusive of bedding and towels. Towels provided for use within the property should not be taken to the pool. Additional towels are provided for use by the pool - no towels must be removed from the rental property at any time.

The Client should keep the rental property and furniture, fittings and effects in the same state of repair and condition as at the commencement of the rental period. The property should also be left in the same state of general order and cleanliness in which it was found. If the property is not left in the same clean state as at the commencement of the rental peirod then a cleaning charge of £40/50euros will be deducted from the security deposit. The Client will be responsible for all damages or losses of the contents during their occupation of the property. The Owners reserve the right to make a retention from the security deposit to cover additional cleaning costs if the Client leaves the "Property" in an unacceptable condition. The Client also agrees not to act in any way which would cause disturbance to the local community.

The Owners shall not be liable to the Client for any temporary defect or stoppage in the supply of public services to the Property, nor in respect of any equipment, plant, machinery or appliance in the Property or its garden nor for any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owners.

We ask that the Client remove all rubbish from the property prior to departure.

Septic Tanks

Being in the countryside, the property has a septic tank. The Client will ensure that all party members follow the instructions available within the rental property.

Swimming Pool

An 11x5m saltwater swimming pool with roman steps and sun terrace are open to guests from 1st May to 30th September, weather permitting. The swimming pool and terrace are shared between the two properties and the Owners. They are not available for use by anyone other than the Client and their parties. The swimming pool is fitted with a security alarm and is fenced for additional security.

Use of the swimming pool is entirely at the responsibility and risk of the Client. The Owners accept no responsibility for accidents or injuries occurring in connection with the pool except where directly caused by the Owners own negligence. The Client agrees to take all precautions necessary to ensure the safety of himself and other members of the party and avoid all dangerous activities in the vicinity of the pool. The depth of the pool ranges from 1.2m to 1.8m and it is the Clients responsibility to ensure that minors are supervised at all times in the vicinity of the pool. No minor is permitted in the pool area without adult supervision. The swimming pool has a liner and the Client agrees to take reasonable care to avoid damage to the pool, to follow the pool care recommendations provided at the time of occupation, and to ensure that glassware or anything sharp is not used in the vicinity of the pool on the grounds of safety to all including themselves. Plastic glasses are provided for use near the pool. The Client will be liable for any damage to the pool caused by failure to adher to this agreement or reckless or wilful action.

Conditions of use are available on the pool terrace and in each gite. The pool will be closed if these conditions of use not adherred to.

Use of the pool and terrace are resticted to paying guests only. To avoid disruption to other guests, visitors are discouraged. Under no circumstances are visitors permitted to use the pool or surrounding terrace.

Bicycle Rental

There are bicycles available for hire at the property for an additional charge of 50 euros per week or 10 euros per day - please reserve at time of booking. A security deposit of 100 euros per bike is payable locally. The following additional conditions apply to the rental of bicycles:

  • The Client will inspect all bicycles at the time of collection and highlight any damage to the Owners before taking possession of the bicycles.
  • It is the Clients responsibility to ensure that the bicycles are all in good working order before use and the Owner shall not be liable for any additional costs, such as transport costs caused by their use.
  • The Client shall take all reasonable care to maintain the bicycles in good condition and ensure that they are returned clean and in good working order prior to departure.
  • The Owners are not responsible for any mechanical failure and the Owners liability is restricted to the rental sum paid for bicycles.
  • The Client is entirely responsible for the use of the bicycles. Helmets are provided by the Owners. The Owners accept no responsibility for personal or third party injury caused by use of the bicycles.
  • The Client shall ensure that the bicycles are locked at all times when they are not in use or out of the Client’s sight.
  • The Client shall report any damage caused to the bicycles or loss of the bicycles to the Owners as soon as possible.
  • The Client will be liable to pay for any damage to or loss of the bicycles. The cost of repair or replacement will be deducted from the security deposit. The Client will be liable to pay any costs over and above those recovered from the security deposit.

Facilities

Every effort has been made to ensure that descriptions of the properties are correct. The Owners cannot accept any liability for changes. The Owners cannot be held responsible for technical problems with the property, facilities or animals, insects or birds which may be present in or around the property. The Owners will do all they can to rectify technical problems reported to them. The use of the accommodation, surrounding property and amenities, (such the swimming pool, rental bicycles, lawn games etc) is entirely at the risk of the Client/user.

The Client shall report to the Owner without delay any defects in the “Property” or breakdown in the equipment, machinery or appliances in the “Property”, garden or swimming pool, and arrangements for repair and/or replacement will be made as soon as possible.

The Client and his party leave personal belongings in or around the property entirely at their own risk and the Owners cannot be held responsible for any injuries or losses however caused. The Client is hereby notified that the presence of a swimming pool at the property presents a potential risk, especially to children.

Alternative Accommodation

Bookings are taken on the understanding that the property booked will be available for the dates specified. If, due to circumstances beyond the Owners’ control, this is not possible, every effort will be made to provide alternative accommodation. Failing this, the Owners will make a prompt and full refund of all monies paid and there will be no claim against the Owners. In the event of a booking being cancelled or altered by reason of force majeure, including floods, storms, riots, strikes, wars and Acts of God, or other events outside the Owners’ control, the Owner cannot accept liability. If the Client or any member of the Clients party falls ill during the rental period or has to return home early for any other reason, the Owners cannot be held responsible for any additional costs nor will any part of the rental charge be returned.

The Owner shall not be liable to the Client

  • for any temporary defect or stoppage in the supply of public services to the “Property'”, nor in respect of any equipment, plant, machinery or appliance in the “Property”, garden or swimming pool;
  • for loss of use of the swimming pool caused by another Clients neglect or damage
  • for any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner
  • for any loss, damage or inconvenience caused to or suffered by the Client if the “Property” shall be destroyed or sustain substantial damage before the start of the rental period by act outside of the Owners control, and in any such event, the Owner shall, within 7 days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.

Cancellation Charges

The following charges will apply in the event of cancellation by the Client:

Up to eight weeks before the start of the rental period: Deposit paid

Less than eight weeks before the start of the rental period: 100% of the rental cost

If, after cancellation, the property is re-rented, the cancellation charge less an administration charge of 15% will be refunded.

Insurance

The Client is strongly recommended to arrange personal comprehensive travel insurance (including cancellation cover) and full cover for the party's belongings, public liability etc since these are not covered by the Owners insurance.

Complaints

In the unlikely event of a complaint with the property or facilities, the Client should report the complaint to the Owners within 48 hours of the rental period and confirm in writing within five days. Failure to do this may result in the Owners being unable to deal with the complaint during the rental period. Complaints cannot be accepted after the Client and his party has returned home and no opportunity has been given for the Owners to address the complaint during the rental period.

This contract shall be governed by English law in every particular including formation and interpretation and shall be deemed to have been made in England. Any proceedings arising out of or in connection with this contract may be brought in any court of competent jurisdiction in England. Please note that these booking conditions will be sent with your booking confirmation/receipt.
